Account Terms

You must be 18 years or older to use this Service.
You must provide your legal full name, a valid email address, contact details and any other information requested in order to complete the signup/registration process and/or continued use of the Service. Please see our Privacy Policy and practices at www.HealthLinktechnolgies.com on how the personal information would be used. HealthLink reserves the right to terminate your use of the Services upon the discovery that the information you provided is incomplete or inaccurate
Login to your account may only be used by one person – a single login shared by multiple people is not permitted
You agree not to share your username and password with other people. You are responsible for maintaining the confidentiality of your Service account and password. It is your responsibility to notify HealthLink if you believe your username or password has been compromised or used in an unauthorized manner either with or without your knowledge. You are solely liable for any losses incurred to us, our affiliates, officers, directors, employees, consultants, agents, and representatives due to any misuse of your account or password
You shall not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws)
You are responsible for complying with all applicable local, state, national and foreign laws related to your use of the Service. You shall not violate any applicable law or regulation; post or transmit any materials that violate any applicable local law; use the Service for any fraudulent or inappropriate purpose
HealthLink may modify, suspend or discontinue this Service at any time, for any reason, at its sole discretion. HealthLink reserves the right to refuse service to anyone for any reason at any time

Payment Terms

Payments need to be made using valid banking credentials (credit card/debit card/net banking/etc.), unless otherwise specified. Free accounts are not required to provide any banking credentials
The free account entitles new, registered users/entities to a free trial usage of the Service. It is provided at no cost to the user/entity. While using the free account, HealthLink may restrict the length of time, number of days, storage limits, page views, number of participating members and the number of Appointments scheduled by the user. HealthLink reserves the right to change the terms, cost and duration of the Free or any other Plans at any time. If the user desires additional services beyond the scope and limitations of the free account, then the user must subscribe to the Service as a paying customer. Any data you enter into the Services, and any customizations made to the services by us for you, during your free trial will be permanently lost unless you upgrade your subscription to one of paid plans.
The Services billed in advance ('Fees', 'Fee') will be non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. HealthLink reserves the right to terminate or suspend an account for non-payment of subscription dues.
All Fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, legal compliances, statutory registrations and reporting.
Payment Method can be any of the two types: i. Online: The Fees could be online through the facility made on the Website. Third parties support and services are required to process online fee payment. We are not responsible for any loss or damage caused to you during this process as these third parties are beyond the control of HealthLink
ii. Offline: The Fees only in the form of cheque/DD could be either collected personally from you or couriered to us. The cheque/DD needs to be made to HealthLink Technologies Pvt. Ltd. We consider the payment process to be complete only upon receipt of the amount to HealthLink’s designated bank account.
Fees not received within the specified due dates could attract late charges of up to 20% of the subscription fees, which may be levied at HealthLink’s discretion
In case of non-payment of Fees within 45 days post the due date, HealthLink reserves the right to discontinue the Services to you and delete all information in your Account, apart from reserving any legal recourse available.
HealthLink does not accept any liability of loss of Content by downgrading your Service
HealthLink reserves the right to change the Service Fees upon 30 days’ notice. Such notice may be provided at any time by posting the changes to the HealthLink site or the Service itself

Cancellation and Termination

The responsibility of cancelling the account solely rests with the user. You may cancel your account at any time by sending an email to info@HealthLinktechnologies.com with your intent of cancellation. There will be no cancellation Fees required
Upon request, we could make arrangements to send you a copy of your data within 7 days from the time your cancellation request is processed
There will be no refund made for any advance payments or fees that have been paid in advance
HealthLink may, at any time and for any reason terminate the Services, terminate this Agreement, or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account

Intellectual Property Rights

You agree that HealthLink owns all rights to the code, databases, visual-design and layout, including all files and images contained in or generated by the software, and accompanying data, of the Service
HealthLink claims no intellectual property rights over the details/data you provide to the Service. Your account and details/data uploaded remain only yours. However, we may use this information for the proper management, provision, and administration of the Service and our business, and as required by law. We may also disclose information if required by law or if we obtain reasonable assurances from the recipient that such information will be held confidentially and used or further disclosed only as required by law or for the purpose for which we disclosed it. We will use appropriate safeguards to prevent the use or disclosure of the information other than as provided for by these Terms, including administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the information
You shall not use any robot, spider, other automated device, or manual process to monitor or copy any Content from the Service
You shall not resell, duplicate or reproduce or exploit, nor decompile, reverse-engineer, disassemble, or otherwise convert any part of the Service without the written consent permission of HealthLink
You shall not duplicate, copy, or reuse any portion of the visual design or layout of the Service, without the written consent permission of HealthLink.
You shall not transmit any software or other materials that contain any virus, worm, time bomb, Trojan horse, or other harmful or disruptive component to the Services
You shall not remove any copyright, trademark, or other proprietary rights notices contained in the Services
You shall not frame or “mirror” any part of the Services without Our prior written consent
You shall not harvest or collect information about Website visitors or members without their express and Our consent
You may not access the Services if you are our direct competitor, except with our prior written consent. In addition, you may not access the Services for purposes of monitoring their availability, performance or functionality, or for any other benchmarking or competitive purposes

Warranties and Liability

HealthLink shall provide to you basic support for the Services at no additional charge and/or upgraded support if purchased separately. However, we reserve the right to charge fees for advanced support or additional services requested by the user, as deemed, at HealthLink’s discretion
b) HealthLink shall use commercially reasonable efforts to make the Services available 24 hours a day, 7 days a week, except for: i. planned downtime (for which We shall give advance notice via the Services and which We shall schedule to the extent practicable during the non-business hours, or
ii. any unavailability caused by circumstances beyond Our reasonable control, including without limitation, acts of God, acts of government, flood, fire, earthquakes, civil unrest, acts of terror, strikes or other labor problems (other than those involving Our employees), or Internet service provider failures or delays
You expressly understand and agree that HealthLink shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if HealthLink has been advised of the possibility of such damages), resulting from your usage of the Service

User Disputes

We are not responsible for any disputes or disagreements between you and any third party with whom you interact using the Service, including payment processors and speech-to-text providers. We are also not responsible for disputes or disagreements between you and any of your customers with or for whom you or the said persons have used the Service. You assume all risk associated with dealing with third parties. You agree to resolve disputes directly with the other party. You release HealthLink of all claims, demands, and damages in disputes among users of the Service. You also agree not to involve us in such disputes. We recommend you to use caution when using the Service.

General Conditions

Your use of the Service is at your sole risk. You acknowledge, understand and agree that HealthLink provides the Service to you “As Is” and “As Available” without warranty or condition of any kind, either express or implied, including, but not limited to, the implied warranties of availability, accuracy, reliability, timeliness, security completeness or non-infringement.
You understand that HealthLink uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run and manage the Service.
You shall not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated, linked to, or partnered with the Service or HealthLink.
Verbal, physical, written or other abuse of any HealthLink customer, employee, member, or officer will result in immediate account termination and legal action as applicable.
You shall not upload, post, or transmit unsolicited email or “spam” messages or otherwise any material that is illegal, pornographic, abusive or obscene.
You agree to defend, indemnify, and hold harmless HealthLink its officers, directors, employees and its agents from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, made by any third party due to or resulting from your use of the Service or your violation of this Terms of Service

We make no representations about accuracy, reliability, completeness, or timeliness of any contents of the Service, including health-related information. Similarly, we make no representations about accuracy, reliability, completeness, or timeliness of any data from third-party vendors or suppliers, or the quality or nature of third-party products or services obtained through the Service. Use of the Service shall be at your own risk. You agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) your use of or reliance on any third-party content, (ii) your use of or reliance on any HealthLink Content or the use of the Service, (iii) any activity on the Service under your log-in credentials, or (iv) your breach of these Terms. We shall provide notice to you promptly of any such claim, suit, or proceeding.
The failure of HealthLink to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Use constitutes the entire agreement between you and HealthLink and govern your use of the Service, superseding any prior agreements between you and HealthLink (including, but not limited to, any prior versions of the Terms of Service).
